Tennessee is the latest state to contemplate banning delta-8 THC. Although local leaders haven’t decided how to regulate delta-8, two bills are now working their way through Nashville. One of these bills would effectively ban delta-8 in Tennessee. However, a competing bill could clear up delta-8 restrictions without getting rid of it.

Anyone involved in Tennessee’s hemp market must pay close attention to how legislators vote on these proposed changes. If one of these proposals passes, it will impact the Volunteer State’s delta-8 market.

Could Tennessee Ban Hemp-Derived Delta-8 THC?

As mentioned in the intro, TN legislators are now reviewing two bills that directly target the delta-8 industry.

Of these bills, HB 1927 is far more restrictive. Under this proposed law, all products with over 0.3 percent THC would be illegal — regardless of whether it’s delta-8 or delta-9 THC. HB 1927 also allows police to arrest anyone who owns or sells delta-8 products with criminal charges.

The other bill up for debate is listed as HB 1690. Unlike HB 1927, HB 1690 wouldn’t make delta-8 products illegal in Tennessee. This more lenient proposal would give the TN Department of Agriculture the responsibility of regulating the delta-8 market. HB 1690 would also clarify that delta-8 products are only for those over 21-years-old, and it would impose an extra tax on delta-8 hemp.

So, Is Delta-8 THC Currently Illegal In Tennessee?

As in many other states, it’s unclear how to treat delta-8 products in Tennessee. Until lawmakers decide on a specific proposal like HB 1690 or HB 1927, there’s no clear guidance on whether Tennesseans could buy and use delta-8 THC.

Everyone in the USA should have legal access to hemp-derived delta-8 products. As long as companies publish third-party lab results that show there’s ≤ 0.3 percent delta-9 THC, they are OK under the 2018 US Farm Bill.

However, since delta-8 has psychoactive properties, it’s not as widely accepted as CBD or CBG. Indeed, Tennessee has no issue with CBD oils with ≤ 0.3 percent delta-9 THC concentrations. THC-related compounds like delta-8 will face greater scrutiny due to their association with delta-9 THC.

Unless Tennessee introduces recreational cannabis laws or a new delta-8 policy, this psychoactive cannabinoid will have a questionable legal status.
