In 2010 the masked characters known as the superheroes of Hollywood Boulevard won a huge federal court case that allows them to continue to perform on the Walk of Fame near Highland Avenue.

The Los Angeles Police Department had previously shooed them from the area for allegedly harassing tourists for tips, but a federal judge issued an injunction that now prevents police from arresting or moving the superheroes for simply being in costume.

So why was Spider-Man kicked out of a public park over the weekend, an event that was captured with a photograph?

The 34th Lotus Festival returned to Echo Park Saturday and Sunday after a multi-year hiatus during which time the lake that is the centerpiece of the fest was restored and renovated.

The event is produced by Los Angeles Lotus Festival, Inc. And although it's sponsored by the city Department of Recreation and Parks, it's a permitted party controlled by organizers.

And organizers didn't want Spider-Man around, apparently.

According to a tweet by the Los Angeles Police Department's Rampart Division, “Event organizers advised that the subject was there w/o authorization and w/o permit. He was warned and released.”

We reached out to a Rampart watch commander but he had no info on the situation. We also called Los Angeles Lotus Festival, Inc. but were unable to reach anyone who could speak for the organization.
