The condition of suspected LAX shooter Paul Ciancia was upgraded from critical to fair, Ronald Reagan UCLA Medical Center said in a statement last night.

The 23-year-old from Southern New Jersey was shot by LAX police Nov. 1 after he allegedly murdered a TSA agent at the airport and wounded at least four others, including two other TSA employees, authorities said. But as a result of his condition he hasn't been talking much:

Word is that he talked to police a little before he was fully hospitalized that day, but federal investigators didn't appear to get his story out of him, or at least the story they wanted to get.

We asked the FBI if, now that he's in better condition, agents would try to reinterview the young man who last lived in Sun Valley.

FBI spokeswoman Laura Eimiller told us, “I'm not able to comment on specific investigative activity or his condition … “

Ciancia got a public defender, however, which could shut down attempts at questioning.

An unsuccessful filing by prosecutors last week to deny the public defender's request to represent him said “Ciancia is hospitalized and under heavy sedation due to gunshot wounds sustained at the scene” and that “Ciancia's injuries … have prevented him from speaking with anyone.”

The DA's filing says Ciancia's family has had the “legal authority to act on Ciancia's behalf

during his incapacitation:”

The practical effect of appointing counsel at this time – other than prematurely selecting the FPD as Ciancia's legal counsel without input from Ciancia – would be to prevent the government from questioning Ciancia, as he would then be a represented party. Significantly, this would also preclude the government from questioning Ciancia, pursuant to the recognized public-safety exception to the Miranda rule, on the possible existence of co-conspirators, organizational support for his actions, and other violent plots about which Ciancia could have knowledge

Federal authorities said last week that Ciancia's roommate gave the 23-year-old a ride to LAX but was unaware what he had allegedly planned.

The suspect from New Jersey allegedly pulled an assault-style rifle from a bag and opened fire on a TSA agent and even went back to fire more rounds before shooting at others, authorities allege.

Within 60 seconds LAX cops were on his tail and shot him, with at least one around reportedly going into Ciancia's head.

Some have said a note Ciancia reportedly had in a bag indicated right-wing extremism and hatred for the federal government on his part.
