Girls Gone Wild founder and lawsuit magnet Joe Francis wasn't #winning in court this week.

His countersuit against casino magnate Steve Wynn, alleging that the Vegas mogul promised a discount on a large gambling debt, was thrown out of Los Angeles Superior Court like Andy Dick at a Hollywood club.

That leaves the onetime “Douche of the Decade” award recipient facing Wynn's own suit, which claims that …

… Francis told a gossip website that Wynn once said he would kill and bury the amateur smut maker. Wynn is suing for defamation. The suit states:

In truth and in fact, Wynn never threatened to kill Francis, nor physically threatened him in any manner, and never said he would hit Francis with a shovel and bury him in the desert.

The claim will move forward in late summer.

Francis' countersuit claimed that he was due a customary big-whale discount of 30 percent on gambling debts but that it was rescinded in 2008 because he was $2 million in the red and hadn't paid up on time. (Kind of answers its own question, doesn't it?).

The video mogul says he was never told the deal would expire, however.
