From the New York State Supreme Court complaint of Andrea Mackris,
an assistant producer on The O’Reilly Factor, against host Bill O’Reilly,
Fox News, 20th Century Fox and Westwood One:
30. “Plaintiff ANDREA MACKRIS has been subjected to the mercurial and unpredictable mood swings of her boss, Defendant BILL O’REILLY, a personality who can be paternal and engaging at one instant, tyrannical and menacing the next.”
32–36. Mackris tells a Fox VP that she broke up with her fiancé and can no longer afford to work at Fox on her $56,000 salary. O’Reilly takes her out to dinner, offers advice on love (“pick up
23-year-old men in bars”), gives her a raise and suggests she might be promoted from assistant producer to producer come year’s end. Then, “O’Reilly’s demeanor abruptly changed. [His] eyes became glazed and bizarrely strayed in opposite directions. Suddenly, without provocation or warning, [he] said . . . ‘and just use your vibrator to blow off steam.’ When Plaintiff reddened, Defendant Bill O’Reilly asked lewdly: ‘What, you’ve got a vibrator, don’t you? Every girl does’ . . . Plaintiff was repulsed.”
O’Reilly also notes that he had taught another woman how to masturbate using a vibrator while he talked dirty with her over the phone. Mackris admits to having never tried phone sex, prompting O’Reilly’s “disbelief.” Emboldened, he tells her that all his sexual stories are based on real-life experiences “such as when he received a massage in a cabana in Bali and the ‘little short brown woman’ asked to see his penis and was ‘amazed.’”
41–42. O’Reilly takes Mackris and her female friend out to dinner. During the meal, he repeatedly propositions the women, “singing the praises of telephone sex, offering to telephone them both, and suggesting the three of them ‘go to a hotel together and have the time of [their] lives’ . . . Plaintiff was extremely embarrassed and protested, ‘Bill, you’re my boss!’” O’Reilly regales the women with tales from the wild side, including how he lost his virginity, the two Scandinavian stewardesses he hooked up with and a “girl” at a sex show in Thailand who’d “blown his mind” in the backroom.
43–52. Mackris leaves Fox for a job at CNN. O’Reilly offers support, counsel and phone sex during Mackris’ stint there. When Mackris’ boss is fired for sexual harassment, O’Reilly worriedly, and it seems unironically, calls to ensure nothing untoward was directed at her.
53–54. O’Reilly suggests dinner to discuss Mackris’ future. She accepts on the condition that the conversation remain professional. He offers her a job; she accepts on the condition that he stop harassing her. He says he wouldn’t do that to anyone who worked for him. She notes that he did it to others, and if he’s not careful, he’ll be exposed. His reply:
“If any woman ever breathed a word, I’ll make her pay so dearly she’ll wish she’d never been born . . . Besides, I’d never make the mistake of picking unstable crazy girls like that.”
57–61. O’Reilly matches Mackris’ CNN salary in an effort to entice her back. She accepts, but when [Fox president] Roger Ailes declines to match Mackris’ salary, O’Reilly gives her a staff position on his radio show to make up the difference.
65–66. Hot and bothered after interviewing two porn stars, O’Reilly calls plaintiff and “launches into a vile and degrading monologue about sex . . . it became apparent that [O’Reilly] was masturbating as he spoke . . . [Mackris] was shocked, frightened and upset. She felt trapped.”
77–81. O’Reilly calls Mackris while watching a porn movie and “babbled perversely regarding his Caribbean vacations because, purportedly, ‘Once people get into that hot weather they shed their inhibitions.’” He goes on: “If I took you down there then I’d want to take a shower with you right away . . . You would basically be in the shower and then I would come in and I’d join you and you would have your back to me and I would take that little loofa thing and kinda soap up your back . . . run it all over you, get you to relax, hot water . . . and I would put it around front, kinda rub your tummy a little bit with it, and then with my other hand I would start to massage your boobs, get your nipples really . . . hard . . . and then I would take the other hand with the falafel (sic) thing and I’d put it on your pussy . . .”
O’Reilly further offers oral sex, fantasizes that Mackris would fellate his “big cock” and talks about their eventual intercourse. When Mackris says she doesn’t want to participate and reminds him that he was her boss, O’Reilly replies: “You just have to suspend that.”
84. “In these days of your celibacy and your hibernation,” O’Reilly tells Mackris, “this is good for you to have a little fantasy outlet . . . I’m trying to tell you, this is good for your mental health.”
