Judge Kozinski Spanked by Panel But Not Disciplined

Alex Kozinski, the Chief Judge of the 9th U.S. Circuit Court of Appeals was reprimanded by a panel of peer judges in Philadelphia today. The group found no judicial misconduct on the part of Kozinski, who last year recused himself from a Los Angeles obscenity trial after the L.A. Times revealed Kozinski maintained a personal Web page filled with sexy photos, bathroom-humor jokes and copyrighted music files. At the time Kozinski said he believed the site to have been password-protected from uninvited readers.

Instead, reports the Associated Press, the panel declared that Kozinski was "careless" and "judicially imprudent" in hosting a site that could, in fact, be accessed by the public. The findings were made by judges belonging to the 3rd U.S. Circuit Court of Appeals and contained in a 41-page summary. Last year's revelations came a day into the trial of Ira Isaacs, a Hollywood filmmaker and distributor of "scat" porn who was accused by the government of trafficking in obscene material. Isaacs' lawyer, Roger Diamond, had strongly urged Kozinski to remain with the trial, but the judge recused himself. The case against Isaacs remains on hold.
