Penn allegedly kicked the shooter outside the store in Brentwood. The City Attorney's office brought the charges after the District Attorney's office declined to file because the alleged actor-on-paparazzo violence didn't "rise to the level of a felony," D.A.'s spokeswoman Sandi Gibbons said.
If convicted on the charges Penn could see as much as 18 months behind bars. In the mid-1980s the actor served 33 days for assaulting a paparazzo.
