Markey claims he used 8mm Film & got mostly the 2 bands Goofing off back stage. (LIKE TODAY>>HUH? Some things Never Change!) Today, I found out DICKHOUSE Prod's has been behind the posting of a Black guy's pix...obese..& lying perhaps on his own future star DEAD! Haha They replaced at my FB the pix of the Black guy lying on the STAR bearing the name LIONEL. (Which is his name) So is it true that MARKEY is going to release the Film & put it in DVD for Sale? BOY...Talk about Cashing In..from 1991!! I understand if he wants to, but the fact he's a kid (20's) & had 8 mm Film...& knew nothing about the law & contracts..& might not today & was just out to 'Document' it as a Great band & have a Blast & FURTHER, He could have released it at any point in their short Career Or anytime AFTER Kurt's Death.& this just...might only lead him to the Legal phrase...IGNORANCE OF THE LAW, IS NO EXCUSE! ***Oh YES...it certainly is used in Courts at all levels; as well as 'Statute if Limitations'.. if at all here.
I give 'MARKEY' credit for his 'insight/vision' to See/Hear something NEW (Wasn't even labeled 'GRUNGE' then, till AFTER they signed with the Label & someone coined the 'phrase'..GRUNGE. More than likely the A&R guy that signed them Or the head of the Label. Possible it was Producer 'Butch Vig' who produced FF's recent CD. It's in Wikipedia I'm sure. In Reality, they were PUNK. But Punk wasn't doing well in sales ..Hence...a new Catagory of Music...'GRUNGE.' No one knew the future of NIRVANA (BUT PROPS TO THEIR PRESS, MEDIA, LABEL, MNGR., AGENT,RADIO DJ's, & For Bringing it to MTV to take off like it did!).
I'm not so sure'MARKEY's Wanting to Release a DVD of NIRVANA will surface, Unless someone pays him Money..& A small amount at that; as Courtney Love (then from band 'HOLE') was his girlfriend & then later his wife..LIKE IT OR NOT!! & THEY had a daughter, Frances Beane, who was only age 4 when KURT mysteriously took his life in April 1994, with a Shotgun and found on his Kitchen floor & question of Heroin used. (I have Pictures of KURT on the kitchen floor dead with the Shotgun.) None of it matters. WHEN YOU ARE GONE..YOU ARE GONE! We don't know where to. Maybe William Shatner (Capt. Kirk of 'Star Trek')...will guide us through it!
So...DAVE...depending on if Courtney has the only say...she may have it released & pay him a small amount of Money, & send him on his Merry Way. It depends who wrote the songs & if KURT had all the rights to the Publishing...then after he died...depending on the language in the Contracts of any Publishers at all...or if that didn't come into play, when they got a lawyer from the label. I believe COURTNEY LOVE, holds all Rights to any Footage, But only if she was his wife at he time of the Filming .. (This was the Pre Mega Nirvana, & at some point she was just his girlfriend.***I believe the tour...if at all, she was his girlfiend, thus, holding NO RIGHTS. If she was with KURT then) It all has to do with the timeing. If there was never a Will, SHE would inherit the rights anyway Of any NIRVANA Material But NOT of the Footage. Lord knows they were all in Court over the rights to the music. She WON After along Battle with the other Nirvana members, the label, publishing..& anyone else like a lawyer. Unless the rights to the songs were sold off to Publishers...which I doubt. (Family Tree&.all) So if Courtney holds the playing cards, legally, it would be her call. I think she would want the sort of PRE Nirvana that's doing openers for Sonic Youth...to be released as Musical History. If she has a heart & soul, she should pay 'MARKEY' a decent amount of money...not 'pittance'.
On the other side of the coin is the FACT that this film/'Doc' that was never released...it did NOT by any stretch of the Imagination MAKE OR CREATE NIRVANA.(That is where you make money in a court, if you can prove you made the band into whatever they become.) He went along for a ride..so to speak. He's into film. I give him Enormous credit to go & do this...EVEN if it's a 'Goofball' Film! KURT & KRIST were NIRVANA & AT SOME POINT SO WAS THE GREAT 'Pat' (Guitarist)...that now is with the Foo Fighters since 1995. ***So Markey I wish you the best. I personally think you are owed something. NIRVANA nor Sonic Youth hated you or treated you unkindly. Which brings me to another topic...KURT was a kind person & would want you to be paid, despite his addictions , if any at the time you filmed them. KURT & DAVE & KRIST had a Blast with you Filming them. RockStars ego & all back then. Sonic Youth too. ***They should step up to the plate & pay you for your film of Capturing Musical NIRVANA History, as an opening act! If it were up to me I'd make Damn sure you get paid for transfering the film into a DVD for Worldwide Distribution, including Radio & TV Video. The Rights of the Footage are yours..that's undisputed....Unless you had them sign anything. A Release Form is always a good idea to protect yourself & your work..even if it's 20 years later.
