Why Was Jewish Radical Earl Krugel Slain in Prison?

Judge Stephen Wilson Keeps Alleged Murder by the Aryan Brotherhood Under Wraps

When an L.A. federal judge closed his court to the public to hear a case in which a widow had charged the feds with wrongful death in her husband’s murder while doing time in prison, some experts called the judge’s action rare or unconstitutional. Even a federal security officer passing by the sealed courtroom found the move odd.

The secret hearing last month was the latest twist in the tale of the violent deaths of Irv Rubin and Earl Krugel, two local Jewish Defense League activists arrested in 2001 for a plot to bomb a Culver City mosque — both of whom died while in custody.

Krugel’s widow, Lola Krugel, wants to know how and why her husband, a Reseda dental technician, was placed in an exercise yard with David Frank Jennings, a known skinhead and alleged Aryan Brotherhood acolyte, who crushed Krugel’s skull with a chunk of concrete just three days after Krugel arrived.

On July 21, 2009, in the ornate downtown L.A. courtroom of U.S. District Judge Stephen V. Wilson, those matters were closed to the press and public.

From a distance, the bomb plot cooked up by Rubin — the JDL’s director and a familiar face around Los Angeles, who continually angled for media exposure, and who was assisted by activist Krugel — was a disturbing version of The Gang That Couldn’t Shoot Straight. The two were arrested for conspiring to blow up the Westside mosque and the office of Lebanese-American congressman Darrell Issa. The Jewish Defense League had long been classified by the Southern Poverty Law Center as a hate group (along with groups like the Nation of Islam).

Then both ended up dead.

Rubin’s shocking 2002 jailhouse suicide came first. He was being held on charges for the bomb plot, and his trial was still a long way off, when officials say he managed to slash his throat with a prison-issued razor, then somehow jumped 18 feet from an upper floor of downtown’s federal Metropolitan Detention Center, dying after nine days in a coma.

Then came Krugel’s even more unsettling death on November 4, 2005, as he started his 20-year sentence in a medium-security federal prison in Phoenix but was promptly bludgeoned to death.

The apparent assailant, 30-year-old Jennings, was an alleged member of the Aryan Brotherhood, a feared prison gang. According to the Southern Poverty Law Center, its members comprise less than one-tenth of 1 percent of the nation’s prison population but commit 18 percent of all prison murders. The Brotherhood is primarily a crime syndicate that runs prison drug trafficking and prison prostitution, but it carries a nasty racist overlay.

Attorneys for Lola Krugel, the spirited and elfin woman who is Earl’s widow, allege that the U.S. government is culpable for her husband’s death. She did not want to be quoted, but her suit charges that prison officials failed to classify Jennings as an Aryan Brotherhood member despite his gang tattoos.

But within minutes of the start of the late-July trial, as Benjamin Schonbrun, the widow’s attorney, questioned former prison employee Thomas Bond about Jenning’s tattoos, Judge Wilson ordered the court cleared — bending to U.S. government attorneys, who wanted internal prison procedures, such as identifying gang members and gang tattoos, to remain secret.

(The federal government is so obsessed with secrecy in this case, that in a hallway of the federal building, when Assistant U.S. Attorney David Pinchas was asked by L.A. Weekly for his name, he only reluctantly provided it.)

In a statement later, Schonbrun said Wilson acted “without a fair hearing to permit anyone to dispute the necessity for a secret trial. When a federal judge can close an entire trial and exclude our free press, our society suffers.”

Strangely enough, a court order issued by Wilson himself, and publicly available, reveals many key prison procedures that had been expected to come out at the hearing. Moreover, the Aryan Brotherhood tattoos that the federal attorneys are so reluctant to discuss in public were found by the Weekly, readily accessible, on a Web page hosted by the Arizona Department of Corrections.

What is known is that in June 2004, before Jennings was moved to the prison in Phoenix, where he allegedly murdered Krugel, Kimberly L. Beakey, the Bureau of Prison’s “designator of inmates” for the Western region, initially qualified Jennings as a “high-security inmate” — but then “flexed down” Jennings to medium security so he could participate in a drug-abuse rehab program that is unavailable in maximum-security prisons.

Bureau of Prison documents show that Jennings had described himself as a member of the Aryan Brotherhood and wore its tattoo — so Beakey specifically noted that further investigation of Jennings was required upon his arrival in Phoenix.

If Jennings was in the Aryan Brotherhood, federal rules required that he be committed to maximum security. At issue at last month’s trial was whether Bond and another prison officer who saw Jennings upon his arrival in Phoenix did enough research before allowing Jennings into the general population, and into the yard where he is believed to have bashed in Krugel’s head.

    The late Earl Krugel, one-time West Coast coordinator of the militant Jewish Defense League, was doomed the minute he entered jail and later federal prison. In every such instituions, contingents of the Aryan Brotherhood, Satan's Few and other white supremacist gangs thrive.Inmates learn who a new arrival is before the inmate transfer bus arrives at the entrance gate of the prison. Given that Krugel had gained noteriety in the news media and talk shows, plus his past activities with racists, his presence in the joint was equavalent of putting his face on the Internet. Another factor against the JDl leader was his age (62) and he wasn't "prison wise". He didn't know what to watch out for, the body language of inmates when trouble is brewing. That being said, it was the vicious and tragic end to an activist, hurt and motivated by anti-Semitism with the memory of six million of his kind dead from Nazi persecution, who only wanted and did, for a while, fight for the rights of the Jewish people others flailed by bigotry, discrimination, racism, homophobia and sexism.

    It's easy to come up with conspiracy theories or to blame the government for Earl Krugel's death. Earl was aka "The Munchkin" in the JDL as opposed to his idiot twin brother Barry (aka "Apeshit"), but the fact is, I predicted years earlier that if Earl ever had to do hard time, he'd be dead quickly because he couldn't keep his mouth shut for more than about 2 seconds. While in MDC, he called a member of the NLR (Nazi Low Riders) a "faggot," which in essence got him a death sentence for as usual, not keeping his mouth shut.

    Steven and Bill Maniachi, thanks for telling it like it is. I knew all along that both of these men were murdered with the complicity of the authorities. It reminded me of the murder of Lonnie Blackmon in the Central Utah Correctional Facility in Gunnison, Utah, where a white supremacist named Troy Kell stabbed a black inmate to death, named Lonnie Blackmon, by stabbing him 67 times while he was handcuffed and his handcuffs tied to a waste band, leaving him totally defenseless. You can see the disgusting video of this cowardly murder if you googe "Troy Kell". A security guard was caught on the video witnessing the murder, and then he quickly ducked away after he realized he was caught on tape. The prison authorities there were just as responsible for the murder of Lonnie Blackmon as they were for the murders of Irv Rubin and Earl Krugel. American law enforcement is nothing but state sanctioned terrorism.

    Unlike 99.99% of the people writing stories about the deaths of Irv Ruben and Earl Krugel, I have first hand knowledge because I was there. I was sent to the Metropolitan Detention Center (MDC) in Los Angeles in 2000 for bank robbery. On my first day there, on the 9th Floor (9 South), I met Irv Ruben. I wanted a cup of coffee but didn't have a cup. Mr. Ruben overheard me complaining to another inmate and said, "If you need a cup, I have an extra one in my house [cell]". I said thanks as I followed him up the stairs to his cell. Near the top of the stairs, he turned around, extended his hand towards me and said, "I'm Irv". Immediately I knew who he was because I had seen him appear on the Jerry Springer (he fought with a KKK member). Anyway, I asked, "Are you Irv Ruben with the JDL?". He seemed surprised that I knew who he was and we had a brief discussion about what the newspapers were saying about him. He gave me a small, plastic green cup (prison issued) and I stated, "I'm going to keep this cup forever and tell my grandchildren that Irv Ruben gave it to me". As we walked out of his cell, he said he wanted to introduce me to his friend, Earl, who had a cell directly across from his. We walked over to Earl's cell and Earl was sitting at his "desk" reading a book. Irv introduced me to Earl and we talked briefly about their case and my charges. The one thing that has ALWAYS stuck in my mind were the last words Mr. Krugel said to me: " I hope to just get out of here so I can take my Grandson to Dinsyland". I was at MDC the day Irv Ruben killed himself. I believe Mr. Ruben knew that the Sentencing Guidelines for his alledged crimes were going to be basically a life sentence (it was post 911). Prison, especially MDC Los Angeles acn quickly consume a person with feelings of hopelessness and being alone in the world. what kind of life would it be to know that you most likely die in prison? I was eventually transfered to FCI Phoenix for the same drug program that David Jennings (Kruger's killer) was. I was placed in the Security Housing Unit (SHU) for almost 3 months before I finally got to mainline (known as the yard). I am white, and I didn't belong to any race groups. I basically was friendly with those who were friendly towards me...regardless of their race. I was on the yard less that 2 months before I was confronted by 3 white inmates asking why I wasn't "hanging with the whites". Before I could even answer, I was punched in the head and attacked by all three of them. I had a cracked rib and my eye was so swollen I couldn't see out of it for over a month. I was placed in the SHU unit again "for my safety" and over the ensuing months, had correctional staff put gang members and other violent inmates in my cell. FCI Phoenix is a prison that is run by the Silent Aryan Warriors (SAW Boys) who are mainly from Utah, and other Hardcore Skinheads that group together. In addition, there are Bikers and "Peckerwoods" that are almost as bad. The Warden, the Special Investigative Service (SIS) and all the other staff members working there not only know about the groups...they do nothing to control them! Again, this is first hand kmowledge. So, If you take a guy like Earl Kruger, a small, older man that just happens to be a Jew...a member of the Zionest Occupied Government (ZOG), and a rumered "snitch" for his plea and testimony after Irv Ruben's death....well, it's no big surprise or shock to me (and problably not to the Warden or the SIS guys) that Earl was killed! The bottom line is, the BOP fed Mr. Krugel to the sharks! The BOP was aware of the dangers Mr. Krugel was under at FCI Phoenix due to the history of violence there with regards to the white STG's housed there. Mr. Krugel could and should have been placed in a lower security prison based on his frail condition and age. I hope that Mr. Krugel's wife wins her lawsuit against the BOP for their gross inability to protect her husband in an environment that has a documented history of violent inmates that "hate niggers and jews".

    Hello Tibby, I have a story suggestion. What about the story of Joseph Moshe, the man who at the Federal building in Westwood a few days ago initiated the big police standoff after threatening to bomb the White House? I think it's intriguing because the suspect proved to be Jewish, contrary to initial widespread belief that it must have been a white supremacist. This could be a good niche topic for the LA Weekly since the story will likely soon be ignored or forgotten by the vast majority of mainstream outlets because of this. I.e., it's not template-appropriate.

    Robert Q, I am the writer of the above story. I make it a point not to respond to comments--it's an opportunity for readers to state their perspectives. But it's a misnomer to equate the Jewish people in general to skinheads, who have a very specific motive. I do appreciate your thoughts about the number of people of color who are imprisoned and who die in prison. I do believe those are important stories. In a related story, the LA Weekly had me investigate a gang raid in Venice last year which netted not gang members, drugs and weapons as the City Attorney claimed--but often frightened grandchildren and grandparents, all of whom were African-American and Latino.     do you have any idea how many people die in prison? they are mostly black and latino people that die but you never hear shit about that? now some white people get into it and its a big deal? the skin heads and jews are the same both full of hatred! let it go....

    Irv Rubin did not commit suicide...he was murdered with the complicity of the United States Government. On the morning of his murder, he was scheduled for a bail hearing and it was generally felt that bail would have been granted. Isn�t it strange that there were no guards present, no surveillance tapes and no witnesses when Irv supposedly cut his throat and threw himself over the tier? Earl Krugel was a Jewish Activist and was a gentle man. Earl's assassination was also planned and his murderers knew he was coming before he arrived in Arizona. Irv and Earl held secrets, which if ever revealed, would cause shockwaves throughout federal law enforcement and the State Department. These men were framed, entrapped, and incarcerated to keep their mouths shut. Out of fear for the welfare of their families, they did keep quiet. There was however, always the possibility that they would reveal the information that terrorized those in power. They were silenced...end of story.
