Esteban Nunez Case: Bad Little Suburban Boys

The son of Fabian Nunez, and his friends, face the music in Lu Santos’ killing

The murder of funny, charming Luis Santos, whose bloody knifing last October has implicated Esteban Núñez, the son of former California Speaker Fabian Núñez, and Esteban’s friends, can’t be dismissed with a tidy cliché about disadvantaged kids killing one another on the mean streets.

Flip the mirror, and its opposite but equally dark image appears. The murder involved educated suburban adults, some moving easily in or around the upper strata of California’s power elite, suggesting vague parallels to the Billionaire Boys Club. The case has elicited the involvement of California’s Democratic Party political stars, from Mayor Antonio Villaraigosa to County Federation of Labor chief Maria Elena Durazo — all rallying around the accused while doing nothing to support the family of the widely loved dead young man, who went, simply, by the name Lu.

Three of the four alleged killers are from Sacramento, and met in and around their private schools. Early evidence suggests that as teens they absurdly styled themselves as a nonexistent gang, “The Hazard Crew.” Their parents — former Speaker Núñez, respected administrative-law judge Daniel Garcia Sr. and a third Sacramento family — either indulged or were clueless about their sons’ pretensions as toughs whose turfs were the leafy, big-lawned suburbs around California’s state capital.

On October 4, the night of the murder, evidence strongly suggests that Esteban Núñez and the others were moody over being denied entrance to a members-only San Diego State University fraternity party, and were drunk and looking for trouble on the streets of the San Diego campus.

Despite the ethnically stereotypical assumptions about their victim, made by some who heard sketchy early news reports of a street stabbing, Santos was not a Latino. He was a gentle Chinese-Portuguese-American jokester raised by his Macau-immigrant father and white mother in the suburban Bay Area. His good friend Charles Dillard remembers the sole “fight” in his life — outside a Tijuana club popular with American college kids, where he got kicked around after getting separated from his friends. The slim and peaceful Santos, says Dillard, just wasn’t equipped to “do much.” He was an incorrigible optimist and Oakland Raiders fan, a lover and not a fighter. He was fun and quirky and beloved. And he was dead at 22.

Lu Santos’ crime the night he died at San Diego State was his ridiculous drunken bragging that he was carrying “a piece” — a fatal and almost certainly untrue crack that he allegedly made to another guy but which was overheard by a brazen bunch of young drunks on the same block. Some in this bunch, down from Sacramento, allegedly carried sharp knives on one of the safest college campuses in the West. Santos argued with them, and was slain by a knife jammed into the left ventricle of his heart. He was left to die in a pool of blood.

Following an April preliminary hearing in which Núñez, Ryan Jett, Rafael Garcia and Leshanor Thomas were ordered to stand trial by Judge Cynthia Bashant, a tragic picture is emerging of a sweet guy who met up with four young men, each of whom played a distinct role in the killing or its cover-up and aftermath.

Facing trial in October are Núñez, 20, a handsome insider and “problem-solver” who knows famous people like the Maloof brothers, co-owners of the Sacramento Kings, and son of Fabian Núñez, one-time golden boy of the Latino power structure and a close friend of Governor Arnold Schwarzenegger; Jett, 23, his sometimes-wild good friend from private school, who got arrested for drunken driving and did probation for messing with illegal weapons; Garcia, 19, third-generation graduate of private Christian Brothers Catholic school, a purported do-gooder who has long been in Núñez’ and Jett’s orbit and is the son of a judge and a Caltrans accountant; and Thomas, 20, Núñez’ friend from Cal State Los Angeles, a high school homecoming king, son of a retired Air Force sergeant and likable follower who went along for the ride that night.

“Privileged people have the feeling of entitlement, that they are above the law and that they should be treated differently,” laments Santos’ computer-consultant father, Fred, from their shattered family home in Concord. “O.J. Simpson got away with murder because he had high-priced attorneys. We hope this isn’t another O.J. Simpson case.”

But as Thomas’ former basketball coach Jim Stephens says, “Not everybody participated that night — there are different levels of guilt.”

Preliminary testimony, although things may change, suggests that only two of the attackers wielded knives, Núñez and Jett, killing Santos and slashing his apparently unarmed friends. Núñez’ lawyer is floating a defense theory that a group of “six or seven” African-American kids were brawling on the same block that night, and could be to blame. Despite the fact that both Núñez and Garcia have hired pricey, Dream Team–style lawyers (Jett’s and Thomas’ families had to use free public defenders), legal experts believe the unified front showed by the four when they allegedly fled the crime and destroyed evidence will unravel like a sweater caught on a hook.

    I came back to read this article as i think it is very well written. As i read the comments below i am appalled at what "Anon" has to say. Obviously this person is associated to the convicted in some manner because no person in their right mind would ever think a victims parent is a "fame whore." First of all, it is rather class less to talk about the deceased, so your comments about Luis are unfounded and disrespectful. Secondly, you weren't there that night to say Luis ever stabbed anyone, the Jett kid probably stupidly stabbed himself with the knife after attacking the victims. And finally, this so called promise that the judge made never happened...the kid took a plea bargain therefore knew what he could potentially be facing. Nunez, like the others should have taken his sentence and dealt with it. But karma will have its way with him. My thoughts and prayers continue to stay with the Santos family. RIP Lu

    I feel I have to reaffirm how dissapointed I am with Arnold. That is such a crock of crap for him to do what he did. How could he do that to those parents? Just a refection of his lifestyle, hope that Arnold or one of his kids (if he has any) or one of his nephews or neighbors children are not the next victims of this insane person.

    I just ran across this article today when searching for articles after hearing or reading about the sentence of the one boy being commuted. I was very disapointed in the Governor. I wonder how familiar he actually was with this case. I think the article was so very well written and I am glad that I ran across it so very long after it had published. Christine did a wonderful job on it. I can see that some of the replies come from the "elite" who are of course furious that the truth sometimes does come out. I am now going to research and see what kind of punishment, if any, these boys got. If the one kid is out of prision I do hope that something really terrible happens to him out in the real world. I hope his dad cannot get him out of the things that are ahead for him. I hope that he gets what he deserves. He may realize that prision was not so bad after all. Of course, with all that money and power he will probably just go right thru life on a siver platter.

    The way the media has depicted Esteban and his friends is the same way Santos should have been depicted. Santos lives of of Vons gift cards, huh? Well go to his memorial page on Facebook and see for yourself he looked like a gangster, he threw up gang signs, and his Vons gift cards bought him a whole lot of alcohol. Almost every picture of Santos shows him drinking alcohol. This is a tragedy for all, not just the Santos family. This could have been the other way around as well, it was a knife fight in which two parties participated. Santos stabbed Jett in the inner thigh before he was stabbed, so how is this not clearly self defense. I believe Santos may have been a charming, funny guy that did not like fighting but when alcohol is involved people do not think clearly. Who is to say he wasn't so drunk that it impaired his judgment to start and pursue a fight. Fred Santos is a famewhore and is pursuing celebrity status. You failed to mention in this article that Judge O'Neil promised Nunez's attorney a lesser sentence if he took the deal for 16 years, he coerced the defense to take the deal then turned around and gave a max sentence. O'Neil started this circus, and he should be held accountable.

    They would have been "jumped" if they haad not called for help from there two other friends. Yes, they had been drinking but they did not start the fight. ALL of there actions were in self-defense. And did you happen to do your research and find out where the fight took place? In front of a campus police station. This is because someone from the VICTIM party had run for help. Is that the behavior of someone who is looking for a fight? And no, not all of the boys who in the "suspect" party deserved to be sentenced to life, they were not carrying weapons. But two of them did.

    What a tragedy for the family and friends of this young man. I am sorry for your loss. I am also sorry for Leshanor Thomas who as of the day of this article was still in jail. His life also forever changed for the tragedy of knowing the younger Nunez and accepting to go a trip not knowing how it would change his life. Nunez is I am sure very comfortable in his million dollar home while Leshanor sits in jail. Where are the letters of support from our prominent black leaders. There was no shortage of support from the latino leader for Nunez. Fabian Nunez I thought you were different. I believed in you and what you stood for. Why haven't you done all within your reach and power to get this young man out of jail. Remember he sits in jail because your son stabbed and killed another young man. How can you sleep at night? Now you have accepted a comfortable new job, lucrative appointments to boards supported by your cronies and you have forgotten all about Leshanor. Shame on you and on your family.

Closely enough that I know that the judge has thrown out a number of inaccuracies in the police documents because they were simply untrue. But you're so educated, you believe everything you read rather than doing research. Bravo for you. Even if you read the warrant, you would see that Santos (Lord keep him) went to go get his friends to continue an altercation with the "suspect" group. But you're being biased because you're angry (rightfully so) and you're passionate. I am as well. You believe these boys got jumped? All of these things will come out in the case. ALL of the boys had been drinking and were stupid, some stupid enough to carry weapons. But not all of the kids in the "suspect" group were carrying knives. That's what I mean when I say read the information carefully. Leshanor Thomas was not carrying a weapon, yet, because his idiot friends were, he should be sentenced to life as well? He fought, just like the boys in the "victim" group did. Where do we draw the line between who should be punished and who should not? That's the point I was trying to make here. With the financial stature of the defendants parent's set aside; a murder took place which is an entirely different situation than a drunken college fight. All the men are responsible; yes, very nice deduction of the event and a wonderful attempt at a reason for defense (you're an idiot). Where in your brilliant comment do you take into account that murder and the use of a deadly weapon are crimes far different than that of a fist fight. Multiple people were stabbed, with Luis Santos left dead."Furthermore," when people are involved in a fight where there are four against three and weapons are used on an unarmed party, it is a case of being "jumped." Another stellar point made by an uneducated fool. Maybe you should read ALL the documents from the case before making another comment. Your parents should be ashamed of having produced such a failure.     It's scary how easily the justice system can be manipulated by rich bullies with important titles. The events of this tragedy are clear. Justice must prevail, not only for Lu and his family and friends, but for everyone. It disgraces American ideals to let prestige distort justice. They are all guilty. Though nothing can bring Lu back to us, these four must be punished like all other murderers and criminals.

Many great comments. let's hope for justice. If I was a prosecuting attorney, i would dwell on the additional fact that a "potential gun" would deter 99% of a confrontation by normal people. The Sacramento 4 should have walked away if they were decent or normal. they were not. Our thoughts and condolences go out to all family and friends of Lu.

    A very well written peice. First off this whole thing is such a trajedy. I had only known LU for a short time but what I did know of him is exactly the same as the article says, he could brighten a room. This whole thing was so senseless, stupid, and messed up. Driven by alcohol and tuff guys. Very tragic. Lu and Brandon were literally fighting for their lives untill my good friends and roomates showed up although it was all to late for LU.. This is a trajedy, hard to think about and read. I definately think there are different levels of guilt here for these young men. I do sympathize with them trying to remain loyal to their family, if I were in their shoes I would have to do the same thing. It just sucks from the other side. Ya know coming up the way this system is its gotta be like that to a certain extent. But not that far. That one night has changed so many lives, its a trip, it didnt need to happen. Im sure everyone involved would love nothing more than to change the course of that evening, but no one can. I hope everyone has learned something from this. Lu's death was not for anything. I know myself personally have made some life long friends and changes in my life because of LU and what happened. I think he would of wanted it that way.. RIP LU!

    i cannot believe that our very own state politicians are already trying to back the defendants in this case. They have no place in this discussion. I happen to know Lu very well and know in my heart that he would never ever carry a weapon on him. He was murdered for no cause by a bunch of wannabe thugs. The fact that these politicans are already trying to back the defendants shows just how corrupt politics can be and makes me feel ashamed to be a Californian. Shame on these men.

    Your article was most informative and in-depth. Thank you for bringing so much to the forefront to educate many of us who were given bits and pieces of this case. I feel sorry for Luis� family who probably re-live that awful October morning many times a day. Just think about it, the Santos family portraits will never be the same, celebrating family parties and holidays will never be the same, their once happy lives, will forever hold a huge void that their son once filled. I was shocked to read in your article that prominent politicians had the audacity to comment on the Nunez kid. I think it is highly inappropriate for elected officials, such as the mayor of Los Angeles, to get involved with a high profile case, such as this. Politicians need to learn keep their comments to themselves. I constantly pray that justice will be served and these four men will pay for this crime. Luis Santos is resting in peace, it�s his family, friends, and relatives who have to suffer through this. May God continue to be with them and give them strength. JUSTICE FOR LUIS SANTOS!!!

    All four of them were PRESENT at the scene. All four of them had the urge to start a fight. All four of them were INVOLVED in the fight. Does not make any difference if you put one in jail... All FOUR MUST SERVE TIME and pay for what they did.

    I went to high school with LeShanor Thomas and he is not the guy that's depicted by this article. Sure, he was popular, athletic and homecoming king, but he was an asshole too! I was a popular kid in high school as well, and he was a jerk to me once, which makes me feel so strongly about him needing to be in jail for the rest of his life. I hope the victim's family gets the justice that they deserve.

    First, i would like to say that this is by far the most indepth article that has been wriiten about this case so far. Not only does it touch on the trial and the actual incident that occured but also gives light into what type of person Luis was. His life was taken too soon and for those of us who knew him he had so much more to give to this world. Readers got a chance to see the Lu that his family and friends knew so that people can put a face to this tragic incident. Another topic that has been less than public but just as important is the fact that so many california politicians are supporting the Nunez family. There is something wrong with this fact. Not because i was a friend of lu's but as a taxpaying citizen i see something very wrong with politicans writing on behalf of a suspected murderer. These politicans have no real insight to who this kid esteban really is...how can they write all these postive attributes about him and lend sympathy to the Nunez family. What about the Santos family? Where is there letter of sympathy from these politicians? Aren't they the real victims here? I hope that the dirty politics will not have a play into the case when it begins in october. Lu, his family and friends deserve a piece of justice. Hopefully more is written on this case so that it is kept in the public eye and will make people think about if money can buy justice.     This is the single article that has covered Lu's story with nothing but facts, leaving out the bull of "self-defense" on the part of Nunez, Garcia, Jett and Thomas. If only Lu could be with us again today. Going with us to beach bonfires, watching the Lakers tonight, making everyone laugh...     The truth will prevail in this case and those who took away Luis Santos will pay for their crimes. They chose to do this horrific act and now must face their consequences. I am deeply let down by our public officials who have rushed to the side of the Nunez family so quickly. Have they no regard for the truth or the facts? Is this how they run their political career as well? Rushing to a conclusion obviously not based on the facts. I am betting that after actually hearing the facts about the case such as Luis never had a gun that night or any other night, or, of the groups involved in the altercation only one fled the scene, and that the weapons involved in the murder were destoryed, that these public officials are wishing they hadn't opened their fat stupid mouths. They should be ashamed of themselves for taking the side of a murderer just to kiss the ass of another crook, the idea of these individuals being elected into public office is pitiful. Money and status will not win in this case so enjoy your freedom right now Garcia and N�as you sit in your fancy homes with your fancy families giving fancy a bad name.     One of the best articles I have ever read. Brought me to tears and made me feel compassion for those involved, I haven't been this swept away by something published since I was a teenager. Thank You so much for all your hard work and research - especially for bringing us to light on who is advocating for who - that certainly paints us all a better piece of what's more important to who. I am an activist and supporter of many who claim to advocate for what's right and I like many others think that politics should have absolutely nothing to do with this case. If someone is involved in a murder case regardless of his position of power they should be treated like any other and if it must play a role in the eyes of the court and people it should never decrease their accusation, but instead make it worse.

    Isn't it clear enough that self-defense is obviously not the case? The defendants are trying so hard to dig deep into a hole that can't be dug from anymore. There is no more soil to dig, so they should stop trying to find irrelevant accusations and assumptions to help back up their actions. PHIL from SD, if you have read the reports you would know that there IS enough evidence to judge. To put it short, witnesses said the 4 men all had knives, getting drunk, getting violent over a frat party and tempting a fight. That sure doesn't sound like self-defense to me. It's more like they brought it on themselves. PLUS, going to the river bank to burn evidence and throw it into the river? If you weren't guilty you wouldn't be trying to hide something. They obviously got paranoid because they KNOW they are GUILTY. They deserve to be punished.

    I have been following this case since October and it is such a terrible tragedy. What a terrible way to lose a son. My heart goes out with deepest sympathy to the Santos family. Thank you to the witnesses who went forth to the police about the stabbing. Without these people who still have warm blood in their hearts, criminals would be running rampantly. However, even with the help of witnesses, today 4 murderers are still free. It is only a matter of time before the 4 men will serve their time and justice will be served for Luis, his friends and his family.

The defendants and their attorneys have tried to hijack the preliminary trial to create confusion surrounding the very real and horrific murder while floating the idea of self defense. The Self-defense defense is an insult to the Santos family as well as to any citizen who walks down a city or college street. If you read both the arrest warrant and this LA Weekly article, you can connect the dots: 1.The only weapons were those used by the defendants 2. None of the victims had any weapons 3. The victims were challenged to fight for their lives Regarding PHIL�S COMMENTS FROM SAN DIEGO his shortsighted analysis will be dissected at trial. It is well noted by witnesses, the defendants wanted to hurt someone and found the perfect pair to attack: thin and gentle college students minding their own business. The bragging? We�ll see about that in court. Perhaps seeing it from your point of view PHIL, you are one of the defendants� mouth pieces. Is this true? Anyone with a subjective mind would read the meticulous evidence and wait blathering until for sentencing.

    In response to Phil from San Diego re; Luis so-called bragging about havng a piece. The media does not always report very well the facts from the case. I always read a newspaper with a grain of salt. Although this is the most in-depth article to date and really great in covering the case, the writer still has some facts wrong. But it will all come out at the trial. Luis did not have a gun, the comment was related by a "witness" who himself was drunk. Whether Lu said that to keep those 4 thugs at bay is unknown. But none of the victims were armed. I agree with your comment "... it is a sad story and out of respect for all, judgement should be withheld until all facts are revealed in court." But in this case, knowing the facts already, I judge. They are guilty, the victim and his frends were in the wrong place at the wrong time. Crossing paths with thugs looking for a fight.

    Those four boys are murderers. They took away an innocent soul away from his friends and family and they think they can just get away with it? No. They took away my cousins life away by murder so their lives should be taken away by locking them up behind bars. Making the world a safer place. If justice is not served then it is basically just letting the world know that if you come from a well known family, or friends with well known people then you are above the law and being rejected from a stupid frat party should be resulted by stabbing someone. If justice is not served i don't know what the world has come to. RIP LU.

    You have to wonder what a group of expensively educated young men were doing walking around the town armed with knives and with an apparent intent to kill (you don't stab someone in the heart unless you want the blow to be fatal). If only their parents had spent more time keeping an eye on their sons and giving them some moral guidance, then perhaps this whole regretful chapter could have been avoided, and a poor innocent boy's life spared. I just hope justice is served, and not bought off, as has a tendency to happen in the world's largest democracy. It sounds like these men really need to realise that life is not one big episode of the Wire. Shame on them!

    If all facts are true, this is a well-reported account. I don't understand why letters of support from prominent figures should result in lowered bail. Actually, these 4 should have no bail until the case is tried. Lu Santos will never walk again.

    These four BOYS, especially Nunez and Garcia have prove their point. They have certainly made it clear that they are not just the sons of a political figure and a judge, but that they are also children. Little adolescent boys with immature minds. They want to portray themselves as tough men who will stand up for anything that will jeopardize a member of their fantasy gang. Well, they've proven themselves tough by taking an innocent life who would have made more positivity in this world than all four of the suspects combined. But I have to ask, why the scared face, Garcia? Why so serious, Nunez? Shouldn't you be proud now that you're shining in your own light and not hiding behind the shadow of your fathers'? Whether Luis did "brag about his piece" or not, it still is not an excuse to take someone's life. If we're trying to stop this sort of violence in the US, shouldn't it be the children of "respectable" figures to help set examples? Instead, we have them running around acting inappropriately and in an unacceptable manner knowing they can get away with anything. Including corrupting other figures to help support them without any consideration of the victims party or even sympathy for Luis and his family. It's absurd. If they still want any respect from any body, stop being cowards and man up. Let your son's go and serve time for what they did. Take responsibility. Hopefully it'll teach them a lesson and stop being spoiled brats. But honestly, let us take a second to think. What has our world come to? Is justice only served if you're "somebody"? Then what is the point of even having a law. Just send everyone to jail except for those who have some sort of status. R.I.P. Lu

    Let there be justice! Esteban, Ryan, Garcia + Thomas should all be put in jail. They were drunk; they had the intention to start a fight and they did, and ended up killing someone. Yes, they had a bit too much to drink, so what. Does that give them an excuse to murder someone during a fight? They said: Self defense, how can it be self-defense if the victims were not armed? They have taken a very special life away; they should be punished for their sins.

    They were carrying deadly weapons, starting fights, then killed someone, left the victim to die, ran away, and then destroyed the evidence. Even bragged about what they did afterwards. No matter who you are, where you are from, and who your parents are. These are the actions of a cold blooded individuals. They should pay for their actions.

    As a Latina I am embarrassed and ashamed by comments made by Mayor Antonio Villaraigosa and County Federation of Labor chief Maria Elena Durazo. People in positions such as theirs should not be taking sides regardless of whose son is being accused. They should have held their comments for after the trial. Where is their compassion for the victim and his family? Shame on both of them.

"Almost certainly untrue crack." The media has reported this story in a very biased manner. Numerous witnesses heard his threat. Two witnesses saw the bulge. One even said, "If it was not a real gun, it certainly looked real." It is sad Luis Santos died. But making threats with a gun is no joke. It is unfair for anyone to assess guilt without being there and knowing what happened. I have sympathy for Luis Santos, his friends, and his family. Just as I have sympathy for the "suspects". Because as the facts have it, nothing has disproven the claim that Nunez and his friends were threatened with a gun. And if so, for them to be painted as guilty cold blooded killers, especially prior to having an opportunity in court to themselves. However the night transpired, it is a sad story and out of respect for all, judgement should be withheld until all facts are revealed in court.

Having been keeping myself updated on the case this article shed new perspectives and I was able to understand the circumstances of Lu Santos' tragic death better. Keep up the good work.

    Pure insanity. The parents should be less worried about damage control and getting their kids off for murder and should worry more about their own part in raising children who would participate in such an act, to whatever degree. Shame shame on the mayor for even getting involved. This is for the courts and the families to deal with. I am so disappointed.

    Look at the LA Mayor. Then tell us that he was/is not a gang member. They all are/were and this is what happens. Wipe out ALL the gang members and the senseless killings will be less. They won't stop but there will be less than what we have now. All the screaming of parents whose children have dies at the hands of gang members fall on deaf ears becaseu no one seems to want to put and end to it. "They (gang memebrs) have their rights after all, don't they?" Send them all to Iraq to fight a real war.

    Thank you Christine Pelisek for your amazingly in-depth story about the tragic death of Luis Santos at the hands of those four. I have rarely seen a story with so much information presented so completely and I appreciate your investigative research. I was stunned and disappointed that so many politically connected people would write on behalf of Nunez or any of the accused in this case. They do not know that Nunez did not do this crime. They do not know Nunez at all. They know how he "looks" to outsiders. Nunez knows how to "present" himself to adults. Luis was a wonderful, happy, easy going young man who loved life, loved his family, loved his friends and made a positive difference to all he met. He would have continued to make a positive difference in the world if not for running into those 4 brats who showed such a huge lack of maturity and respect for others.

    these kids are bored and have nothing to do but harm. we see this time and time again kids that are well off are not always well off in the brain. they see there parents acting like mafiosos above the law so they follow. just like racisms, hate and being gay you are not born that way someone injects it into you at a young age. in da hood kids grow up more normal but in more danger.

    Great article, very well detailed. Not surprising that Villaraigosa made supportive statements about Nunez' son. He has done this before, for convicted cocaine trafficker Carlos Vignali in the Pardongate scandal. He did this because Horacio �Carlos� Vignali his father, was a developer in Downtown Los Angeles and business partner of George Torres, a convicted murderer, drug trafficker, and of course, land developer in Los Angeles. I hope Luis Santos' friends start a huge viral campaign to bring awareness to the injustice that may well be coming. That way maybe the media won't be able to ignore it.

    I am very sorry for the family of the victim. It is a shame that his early death was caused by some kids who thought they were above the law. Politcs should not dictate the manner in wich the law is administered. As harsh as it may sound, sometimes examples need to be set, in order to deter future behavior. Not only will the suspects be on trial, but also the impartialness of the law. Fabian Nunez has to allow the justice system to run its course, without any political influence. His son is still innocent until proven guilty and what ever the outcome of the trial is, he has to accept that. Finally, it seems that as a society, we are getting tired of our elected officials being above the law. The era of when Edward Kennedy and a plethora of other senators and congressmen have been set free is coming to an end. The people need their members of government to be held accountable and held to higher standards than the private citizen. They are elected to lead and should do so by example.
