Two more firefighters rake in fortunes, this time for reverse discrimination

TWO FIRE CAPTAINS WHO WERE SUSPENDED after black firefighter Tennie Pierce was fed dog food during a station-house prank were awarded a total of $1.6 million in damages today by a Los Angeles Superior Court jury.

Captains Chris Burton and John Tohill alleged that because they are white they received harsher punishment from Los Angeles Fire Department brass than the Latino firefighter who actually pulled the prank. Jorge Arevalo slipped dog food into Pierce's spaghetti in October of 2004, and received a six-day suspension. Burton and Tohill were suspended for 30 and 24 days respectively. They were not involved in the prank, they alleged, but as the supervisors on duty failed to inform higher-ups.

The two captains filed their reverse-racial-discrimination lawsuit in 2006. Their attorney says they had hoped to settle for $250,000 each, but private attorneys hired by City Administrative Officer Karen Sisson turned the settlement down — and now the city must pay far more.

Pierce sued in 2005, claiming racial harassment among other things. He settled with the city for $1.43 million last year after the Los Angeles City Council's original settlement offer of $2.7 million was vetoed by Mayor Antonio Villaraigosa.

The original Pierce settlement offer set off an uproar when photos emerged showing Pierce was a big-time, and politically incorrect, prankster himself, spraying water into the face of one strapped-down firefighter, smearing shaving cream around the groin area of another, and gleefully laughing at a third who was wrapped in a sheet on which hazers had scrawled, "Oy Vey! I'm Gay!"

The two captains and Pierce were all working at Fire Station 5 in October 2004 when the dog-food incident occurred. Tohill admitted during the three-week trial that he bought a can of dog food, but only to give to Pierce as a "Joke Trophy" for Pierce's victories in volleyball and handball games - during which Pierce dubbed himself "Big Dog." Tohill said there was never a plan to slip the dog food into Pierce's meal. The two captains were later disciplined and transferred because of the incident, which marred their careers.

An attorney for the two captains, Gregory W. Smith, maintained that the incident was not racial and his clients were unaware that Arevalo had cooked up a plan to feed Pierce the dog food.

The city argued that the two captains were there when the prank occurred, and were actively involved in a cover-up of the incident. The city insisted that the suspensions didn't have anything to do with the fact that they are white and Pierce is black.

It was a matter of the city "doing the right thing," said city-appointed private attorney Edward Zappia. The two captains were disciplined because they didn't prevent the prank and agreed to keep the prank a secret to "avoid responsibility," he argued.

"[The city] took appropriate action in response to an employee complaint," argued Zappia. Instead, Zappia insisted, the two captains refused to take responsibility, "blamed everyone but themselves," and sought revenge against Pierce and Battalion Chief Steve Coleman — who recommended that the two captains be punished for the incident.

"Instead of accepting responsibility they are here to seek revenge," Zappia argued — unsuccessfully.

The mostly white downtown jury didn't seem swayed by the fact that both men, who are still employed by the LAFD, earn more than $200,000 annually. The two-week trial involved a lot of "he said, he said" conflicting testimony, as well as a cast of characters that included both Pierce and Arevalo.

At the trial, Pierce — noticeably peeved by the proceedings — admitted that he participated in pranks, most notably one two days before the dog-food debacle in which a firefighter was strapped down and doused with A.1. sauce. Pierce, 52, also told the jury that he was at first suspected of being the perpetrator behind "Ratgate," in which a dead rat was put into another black firefighter's locker.

"Because you pulled a lot of pranks, right?'' Smith asked.

"No, sir, that's not true,'' Pierce replied.

Pierce, dressed in a yellow tie and black suit, told the jury that, on the day of the dog-food incident, he went into the station-house kitchen for dinner and was met at the door by Arevalo, who told him his dinner was on the stove.

Pierce said he was about to take a third bite of the spaghetti when he noticed something was wrong with the meat sauce. He looked up from the table and saw some of his colleagues laughing, stood up and asked if someone put something in his food. No one replied, and Arevalo offered to make him another plate.

He testified that he asked Arevalo again, but that the Latino firefighter didn't reply. Angry, Pierce left the room because "it wasn't a good time for me to see anyone," he testified.

Surprised by the longtime prankster's reaction, Arevalo and two other firefighters found Pierce, apologized and offered to eat some of the dog food. He told them it wasn't necessary — but said he wouldn't forget about the incident. Later, Pierce claims, he was summoned to the front office to meet up with the two captains, who apologized and told Pierce that they knew dog food was on his plate but he "wasn't supposed to eat it.''

    No, I don't wonder why they are suing. I know that they all sued and either won a big jury award or settlement because they were retaliated against and/or discriminated against by the LAFD administration. That's against the law. That's why they won, in addition to the poor investigations conducted by the LAFD, and other failures by top brass. Hurt feelings you say? It's the evidence that counts. Not what some anonymous poster thinks.

    I did get my facts straight. Not all of the 32 lawsuits from 2004 to 2007 are employment/labor related. Some of the lawsuites are Workers' Compensation claims, traffic accident claims from civilians, and other misc claims against the Fire Department that have nothing to do with their employees. The Daily News lumped all lawsuits together. Of the 5 lawsuits that have gone to trial (Lee Mellinger, Bressler, Lima, Burton/Tohill) all of the members has recd some type of discipline. Makes you wonder why they are suing huh?

    The Daily News failed to report in depth on the 32 lawsuits filed against the LAFD between 2004 and 2007. Those 32 lawsuits include Workmens Compensation claims, citizens suing the fire dept for a host of items (damaged property during fires, people who die in police custody who have paramedics work on them, traffic accidents when civilian cars hit fire engines. Not all of the 32 lawsuits are employment/labor related. The five lawsuits that have gone to trial (Bressler, Mellinger, Lee, Lima, Burton/Tohill) were all from employees who had received some type of discipline and had their feelings hurt. Do some research and dont believe everything the paper prints. Remember just because someone wins a lawsuit, does not mean they were right or should have won

Of the 19 resolved, 15 resulted in settlements or judgments totaling $18.2 million to the plaintiffs, with one pending. Several verdicts are on appeal. And with 13 lawsuits still outstanding, a spokesman for City Attorney Rocky Delgadillo said his office thinks it's unlikely the city can count on a decrease in payouts any time soon. "With the threat of class action and the emerging increase of employment cases, we believe that it is unlikely that we can count on a decrease in payouts," spokesman Frank Mateljan said." The administration of the LAFD is responsible for these costly debacles. That's what the firefighters are saying in their lawsuits, and after seeing all the evidence from both sides, the jurys are agreeing.

    6 lawsuits out of 4000 employees. Look at the employees suing and I bet most of them have been disciplined and had their feelings hurt. No wonder attorneys love downtown juries, its like winning the lotto

    All I know is that the jurors keep siding with the firefighters who are claiming foul by the administration. That's a red flag at the very least about leadership in the top rung.

    Maybe it takes a settlement verdict like Burthill's to wake up LAFD to change things up. Blaming the jury is a pathetic blame the victim mentality just hides from the truth: this case was not winnable because discrimination did occur. Stop kicking sand in the face of jurors and get your beach towel rolled up behind the right side of the sun next time.

    John, How about if we abolish all discipline for all of the firefighters. Hell as a taxpayer I shouldnt expect my firefighters to be honest, drug free, ethical with integrity and morals. They didnt like the previous Chief and now they dont like the currentl Chief, give me a break. If they hate the boss that much they should leave, but no cant turn down the overtime, 4 days off, pension, benefits, etc etc. can they. Stop whining about unfair discipline. Do your job, treat your co-workers with respect and dignity. Remember the citizens you work for, we vote for your raises, benefits, etc.

    GPS - how about the Captain Frankie Lima trial? That's a big story you don't read much about that blew the whistle on former Fire Chief Bamattre and his puppets. It looks like serious trouble is brewing for the new Fire Chief too. Doug Barry's approach to discipline will come under fire soon.

    To John, You stated in your post "All these trials" How many have there been? (3 or 4). I am sure Pierce, Lee, Bressler, Mellinger, all who have sued also deserved to win.

    What these huge monetary awards and settlements indicate is that the LAFD's disciplinary system is corrupt and biased. Odds are all these trials and all these juries can't all be wrong. Too many fingers pointing at bad leadership at the top. Doubt there will be real change until those bad apples are long gone.

You firemen have it too good, playing volleyball on the beach in the morning and working all the overtime you want. How much do you make a year? Grow up and act like a man and a professional.     To LAFD member - how petty that you tell "Another LAFD member" to to brush up on "yer" English on his four days off. It sounds like you are one of the unhappy LAFD members who can't recognize a joke or sarcasm when it's entirely obvious to others. I suggest you lighten up and on your four days off you should brush up on your personality and take a self-improvement course. Those captains should feel no remorse for the award the jurors felt they were due, and I agree it's their money to do with as the please... and yes, it's none yer business.

    Accountabiity, Integrity, Responsibility. The jurors got it right. I just question who is paying the salaries of the Captains suppling the Private Law Firms with Fire Department information. Finally, to be vindicated is one thing, but the pocket books of the Deputy Chiefs in charge are still full. Come on Chief Barry DO YOUR JOB!

    Not being nosey. Just merely stating what Burton and Tohill said at their trial and echoing the opinion of many of my friends that real men of courage also keep their word. If it truly is not about the money they will prove it by donating half of their ill gotten gains to a charity of their choice. On your four days off you should brush up on "yer" english

    To End of This Story If Burton and Tohill are truly not "in it for the money" as they stated in their trial, they should give half of their taxpayer subsidized award and give it to the Los Angeles Firemens Relief Association Widows and Orphans Fund to support the families of "real men of courage" who have sacrificed themselves for the citizens of LA, and not fleeced them.

    Anyone who knows Chris Burton and John Tohill personally or anyone who has worked with them know they aren't in it for the money. Why would I or anyone listen to people who don't know all the facts or the people involved? Thank God for our legal system and firefighters like Burton and Tohill. A good end to this story.

    Yes, I DO know it's a free country.. I defended it PROUDLY during Operation Desert Storm. My position however doesn's change though about giving Tohill & Burtons Business Phone numbers up...At the end of the day, thats STILL some WEAK S#!T

    Hey Swaah. Its a free country and a person can give out phone numbers if they want. Just like anyone can sue, even if its bogus. Isnt America great? By the way, only the station numbers were given out. Lee and Pierce are no longer assigned to a station so their numbers are not available.

    We don't need to call up greedy firemen like John Tohill and Chris Burton to tell them what we think. We'll tell them right here how embarrassed they should be. I hope they see this. Great job, slugs! Thanks for pursuing gutter justice and standing up for the truth. You not only have the courage it takes to run into burning buildings (at 42's and 49's???), you also have your cohorts in Bressler, Lee, and Mattox to stand up to corrupt LAFD management, regardless of the cost to the taxpayers. We all know that you were in this just for the money, and nothing can repair the harm you have done to your fellow firemen on the LAFD.

Thanks for pursuing justice and standing up for the truth. You not only have the courage it takes to run into burning buildings to save strangers, you also have the spiritual courage to stand up to corrupt and weak LAFD management, regardless of the cost to yourselves. We all know that you weren't in this for the money, and no amount of money can repair the harm done to you and your families by the LAFD. Your true reward comes in doing what's right. You have been vindicated, and have the set the example for others. It's a shame that lawsuits and big jury awards are the only things that gets the attention of LAFD management and the City.
